Terms of Service

By accessing or using the Vianto website and application (the “Service”), you agree to these Terms with Gilles Bertheau (“we”, “us”). If you do not agree, do not use the Service.

The Service provides educational wellness information. It is not medical advice, diagnosis, or treatment. It does not replace a qualified clinician. You are responsible for your health decisions.

You must be at least 18 years old to use the Service.

You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account.

You retain rights to content you submit (e.g. uploads). You give us permission to use that content to operate and improve the Service, including processing it with automated systems and third-party providers.

Paid features are billed as shown at checkout (e.g. one-time purchases via Stripe). Taxes may apply where required.

No refunds after confirmation. Fees are generally non-refundable. Before you confirm your bloodwork or extracted lab values in the Service, you may review and correct them if automated extraction or display was wrong. Once you confirm, that purchase is final and we do not provide refunds for change of mind, dissatisfaction with educational content, or unused analyses, except where mandatory law in your country requires otherwise.

You agree not to misuse the Service, break the law, attempt unauthorized access, or harm others.

Parts of the Service may use automated systems. Outputs may be incomplete or incorrect. Do not rely on them as medical or professional advice.

The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits or data.

To the extent permitted by law, our aggregate liability for claims arising out of or relating to the Service shall not exceed the greater of (a) the total fees you paid to us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) fifty Swiss francs (CHF 50).

You will defend and indemnify us against claims arising from your misuse of the Service or violation of these Terms, as permitted by law.

We may suspend or terminate access if you violate these Terms or if we stop offering the Service.

Gilles Bertheau is based in Switzerland. These Terms are governed by the laws of Switzerland, without regard to conflict-of-law principles.

The Service is available in many countries, including the United States. If you are a consumer, mandatory consumer protection laws of your country of residence may apply and cannot be contractually waived.

Subject to those mandatory rules, you agree that the courts of Switzerland have exclusive jurisdiction over disputes arising from these Terms or the Service. If mandatory law gives you the right to bring claims in your home courts, that right remains available.

We may update these Terms. Continued use after changes means you accept the updated Terms.
